Return-to-Duty Process

How the DOT Return-to-Duty Process Works

The driver must complete the required steps before returning to DOT safety-sensitive work. Follow-up testing takes place after the return-to-duty requirement has been successfully completed.

1

DOT Violation Occurs

A DOT drug or alcohol program violation removes the driver from safety-sensitive functions and begins the required SAP return-to-duty process.

2

Driver Completes the SAP Process

The driver completes the SAP evaluation and any prescribed education and/or treatment. After successful compliance, the driver may proceed to the applicable return-to-duty test.

3

Return-to-Duty Test Is Completed

The employer directs the required return-to-duty drug and/or alcohol test. The applicable testing requirement must be successfully satisfied before the driver resumes safety-sensitive duties.

4

Follow-Up Testing Begins After Return to Duty

The SAP establishes a written follow-up testing plan. After the driver returns to safety-sensitive work, the employer carries out that plan using the required unannounced follow-up tests.

Understanding the Requirement

What Is DOT Return-to-Duty Testing?

DOT return-to-duty testing is a required step for an employee seeking to resume safety-sensitive work after completing the SAP requirements following a DOT drug or alcohol violation.

1

Not a Routine Drug Test

A return-to-duty test is not the same as a standard pre-employment, random, or company-policy drug test. The test must be identified using the proper return-to-duty reason.

2

Occurs After SAP Compliance

The driver must first complete the SAP process and prescribed requirements before proceeding to the return-to-duty test.

3

Occurs Before Safety-Sensitive Work

The employer must not allow the employee to resume DOT safety-sensitive functions until the applicable return-to-duty testing requirement has been successfully completed.

Direct Observation Required

Why Is a DOT Return-to-Duty Drug Test $95 Instead of $65?

A return-to-duty drug test uses a different collection procedure than a standard DOT drug test because federal DOT rules require the return-to-duty drug collection to be conducted under direct observation.

Under 49 CFR §40.67, the employer must direct a collection under direct observation when the drug-test reason is return-to-duty. The collection site therefore must perform the additional DOT observed-collection procedures.

Because of this additional collection requirement, CDL Inquiry's DOT return-to-duty drug testing service is $95, compared with $65 for a standard DOT drug test.

The $95 amount is CDL Inquiry's service price. It is not a government-established DOT or FMCSA fee.

Important distinction: Direct observation applies to the return-to-duty drug specimen collection. If an alcohol return-to-duty test is required, the applicable DOT alcohol testing procedures apply.
Standard DOT Drug Test Regular DOT collection when direct observation is not otherwise required.

Before Returning to Work

What Result Is Required to Complete the Return-to-Duty Test?

The applicable return-to-duty testing requirement must be successfully satisfied before the driver may resume DOT safety-sensitive functions.

Return-to-Duty Drug Test

The employee must have a verified negative drug test result before resuming the performance of safety-sensitive duties.

Return-to-Duty Alcohol Test

When an alcohol return-to-duty test applies, the employee must have an alcohol concentration of less than 0.02 before resuming safety-sensitive duties.

Passing the test does not guarantee employment. Successfully completing the SAP and return-to-duty testing requirements allows the employee to be considered for a return to safety-sensitive work. The employer retains the employment decision.
Employer Authorization

Who Sends the Driver for a DOT Return-to-Duty Test?

Return-to-duty testing is part of an employer-controlled DOT compliance process. It is not simply a regular test that a driver orders independently and then uses as proof of completing the federal return-to-duty process.

Current or Prospective Employer

For an FMCSA-regulated CDL driver with a current or prospective Part 382 employer, the employer directs the driver to complete the return-to-duty test and handles the applicable Clearinghouse responsibilities.

Owner-Operator / C/TPA Process

Owner-operators are required to use a designated C/TPA for applicable Clearinghouse return-to-duty responsibilities. FMCSA also provides a limited C/TPA pathway for certain drivers without a current or prospective employer.

How to Coordinate Return-to-Duty Testing With CDL Inquiry

Once the driver has successfully completed the required SAP process and is ready for return-to-duty testing, the employer or appropriate C/TPA should coordinate the correct test before sending the driver to the collection site.

1. Confirm SAP Completion

Confirm that the driver has completed the prescribed SAP education and/or treatment requirements and may proceed with return-to-duty testing.

2. Contact CDL Inquiry

Provide the information needed to identify the proper return-to-duty test and coordinate the collection location.

3. Authorization Is Prepared

CDL Inquiry prepares the testing authorization and collection-site instructions so the test is conducted using the correct return-to-duty reason.

Ready to Schedule the Return-to-Duty Test?

If the driver has successfully completed the required SAP process and is ready for return-to-duty testing, place the order and CDL Inquiry can coordinate the testing authorization.

What Happens After the Return-to-Duty Test?

A successful return-to-duty test is not the end of the DOT compliance process. Once the driver returns to safety-sensitive duties, the employer must carry out the SAP's follow-up testing plan.

01

RTD Result Is Completed

The applicable negative drug result and/or alcohol result below 0.02 must be obtained before the driver returns to safety-sensitive functions.

02

Employer Determines Return to Work

Once the regulatory conditions have been satisfied, the employer decides whether to return or hire the employee into a safety-sensitive position.

03

Follow-Up Testing Is Carried Out

After the driver returns to safety-sensitive work, the employer must carry out the SAP's written follow-up testing plan using unannounced follow-up tests.

Know the Difference

Return-to-Duty Test vs. Follow-Up Test

Both are part of the DOT return-to-duty process, but they occur at different stages and serve different purposes.

Testing Type When It Occurs Purpose Drug Test Observation
Return-to-Duty Test After successful SAP compliance and before returning to safety-sensitive duties. Establishes that the applicable return-to-duty testing condition has been met before the employee resumes safety-sensitive work. Direct observation required.
Follow-Up Test During safety-sensitive duty after the employee returns to work. Conducted according to the SAP's written follow-up testing plan. Direct observation required for follow-up drug tests.
Frequently Asked Questions

DOT Return-to-Duty Testing FAQ

When can a driver take a DOT return-to-duty test?

The driver must first complete the required SAP process, including any prescribed education and/or treatment, before proceeding with the return-to-duty test.

Is a DOT return-to-duty drug test directly observed?

Yes. DOT regulations require a drug collection to be conducted under direct observation when the reason for testing is return-to-duty.

Why does CDL Inquiry charge $95 for the return-to-duty drug test?

A return-to-duty drug test requires the additional DOT directly observed collection process. CDL Inquiry's return-to-duty drug testing service is therefore $95 compared with $65 for a standard DOT drug test. These are CDL Inquiry service prices, not government fees.

What result is required on a return-to-duty drug test?

The employee must have a verified negative drug test result before resuming safety-sensitive duties.

What result is required on a return-to-duty alcohol test?

When an alcohol return-to-duty test applies, the employee must have an alcohol concentration of less than 0.02 before resuming safety-sensitive duties.

Can a driver simply order their own return-to-duty test?

For an FMCSA-regulated driver with a current or prospective Part 382 employer, the employer directs the driver to the return-to-duty test. FMCSA provides a separate limited C/TPA pathway for certain drivers without a current or prospective employer.

Does a negative return-to-duty test automatically mean the driver gets the job back?

No. Successfully satisfying the DOT return-to-duty requirements does not require an employer to reinstate or hire the employee. The employer makes that personnel decision.

What happens after the return-to-duty test?

Once the applicable return-to-duty requirements are satisfied and the employee returns to safety-sensitive duties, the employer must carry out the SAP's written follow-up testing plan.

Who creates the follow-up testing plan?

The Substance Abuse Professional establishes the written follow-up testing plan after determining that the employee has successfully complied with the SAP's education and/or treatment recommendations. The employer then carries out the required unannounced follow-up testing after the employee returns to safety-sensitive duty.

Is return-to-duty testing the same as a pre-employment drug test?

No. Return-to-duty testing is a specific DOT testing reason connected to a prior DOT drug or alcohol violation and the SAP process. A routine pre-employment test does not replace a required return-to-duty test.
